How Danish Online Gambling Regulator Protects Players from No-license Casinos

On 1st January 2012, Denmark enforced a new set of law which saw forth great liberalization of the gambling industry. Players can participate in the legal online casino games without fear of being penalized. You can enjoy an array of online poker, card and table games as a Danish resident. Both the players and the Denmark authority were excited as the gross revenue of online gaming has increased significantly.

The new law aims to protect players from shady casino operators who violate the law. You can roll the dices in the different licensed casinos or choose a foreign one that is licensed.

Spillemyndigheden has the power to regulate online gambling activities across the country.

In 2018, Danske Spil established three separate searches so as find illegal online gambling website hosting. The operation targeted 742 websites that proved dangerous to Denmark citizens. Out of the number, only 22 websites were targeted by the authorities and were notified that they had violated the Danish Gambling Act.  Internet Service Providers had to block 18 of them for failing to respond to authority.

Due to the tireless effort to protect the players, Denmark was recognized by the European Gaming & Betting Association that evaluates all EU countries. It proved to win the illegal gambling battle and offer a safe environment for wagering lovers. Since the enforcement of DGA in 2012, the Danish court has shut down 90 websites with 25 of them blocked in 2019.

In a publication made on April 2020, Morten Niels Jokobsen, Spillemyndigheden director said that they aim to protect players against illegal wagering. They need to stay alert and clamp down any unlicensed gambling activity. He added that they were on the lookout of skin betting via videos which particularly attract the minors.

License Application for Online Casinos

License Application for Online Casinos

Whether you are a local or foreign online casino operator and wish to operate Danish wagering, you require a license from Spillemyndigheden. An application fee of DKK 237,500 is payable to the authority when handing in your application form. The fee is not returnable even if you are not granted a license for your casino.

The applications are sent to the Danish Gambling Authority using their digital form. You need to have a CRV number to apply but if you don’t have it, you must send your application using Bluewhale.

The application needs to be organized properly into files, with each file having a clear title and number to prove your application. You cannot send a hard copy version of your application or use a USB. This is usually enforced by Spillemyndigheden to prevent corrupt operators from applying for licenses right from the beginning.

Whether you are a licensee from Denmark or outside EU or EEA, you must have a representative from Demark. The individual or the company must be approved by the Gambling Authority. To obtain the license you must also prove that your company will function in the appropriate financial and professional way.

The Danish Gambling Authority has the power to withdraw your license if you or your representative does the following;

  • Convicted of a criminal offense that may risk the operation of your gambling activities by misusing them
  • Violation of the Gambling Act repeatedly or grossly.
  • Violation of the duty to pay outstanding taxes repeatedly or has/have not paid security for such taxes.
  • Organize or provide games that disturb the public domain significantly.
  • No longer prove that wagering activities can be carried out in the appropriate financial and professional manner.
  • Failure to pay outstanding fees that are set out in section 42 of the Gambling Act.
  • Exceed unpaid public authorities depts that stand beyond DKK 100.
  • Failure to apply for the registration of the company within four weeks after the license was issued with the tax administration and customs.

ROFUS

ROFUS, the Danish Gambling Authority register that allows players to exclude themselves voluntarily from gambling temporarily or even permanently. They are three different ways a player can exclude themselves;

  • A brief break from playing (24 hours)
  • Temporary self-exclusion (1,3 or 6 months)
  • Permanent self-exclusion.

ROFUS

As an operator, you must be able to offer the above self-exclusion options to all your players. You must also inform your players about ROFUS and refer them to DGA’s homepage for understanding better. If a player is already in the register, you are not allowed to open an account for them even if it is a temporal one. This helps to reduce the number of addicts in Denmark effectively, but still many of them avoid ROFUS by searching ‘spil uden NemID’ (casino without ROFUS, in Danish).

A player who has decided to take a permanent self-exclusion can ask the DGA to delete their names after one year from the date they registered with ROFUS. Afterward, the player is permitted to open another account. If you had chosen a temporal self-exclusion, your exclusion will be terminated automatically after expiry.
